The Supreme Court today ruled that government doctors doing private practice cannot be booked for corruption or being engaged in unlawful trade.

A Bench comprising Justices Markandey Katju and Gyan Sudha Misra passed the verdict, while setting aside a Punjab and Haryana High Court judgment upholding a corruption case filed against two state government doctors posted in Koom Kalan in Ludhiana district.

An FIR had been lodged against Dr Rajinder Singh Chawla and Dr Kanwarjit Singh Kakkar on April 9, 2003 under the Prevention of Corruption Act (PCA) following a complaint by a person who claimed that the two doctors, while functioning from home, had charged him Rs 100 as prescription. According to the complainant, government doctors are not supposed to charge any fee from the patients and doing so amounts to corruption.

The SC Bench noted that under the PCA “corruption is acceptance or demand of illegal gratification for doing an official act. We find no difficulty in accepting the submission and endorsing the view that the demand/receipt of fee while doing private practice by itself cannot be held to be an illegal gratification as the same obviously is the amount charged towards professional remuneration.”

Further, it would be “preposterous in our view to hold that if a doctor charges fee for extending medical help and is doing that by way of his professional duty, the same would amount to illegal gratification as that would be even against the plain common sense.”

Government doctors would come under the purview of the PCA or other criminal offence if, for instance, they took money for admitting patients in government hospital or prescribed unnecessary surgery for the purpose of extracting money by way of professional fee and a host of other circumstances, the apex court noted.

The Bench also ruled that the accused doctors could not be booked even under Section 168 IPC for engaging in unlawful trade. “In our view, offence under Section 168 of the IPC cannot be held to have been made out against the appellants as the treatment of patients by a doctor cannot by itself be held to be engagement in a trade as the doctors’ duty to treat patients is in the discharge of his professional duty which cannot be held to be a trade so as to make out or constitute an offence.”

The accused doctors could be subjected only to departmental proceedings for violating government instructions that allowed private practice only with permission, the SC ruled.

An old woman is on the floor with a bag next to her. She asks the passing school girls for any amount of cash, but the girl refuses with a middle finger. Her friends clearly don’t notice the situation, let alone care about it. The helpless woman just looks at her in desperate pain and shock as the little girl just smirks at her.
This picture breaks my heart. The senile woman is on the floor in beautiful, cultural garments, but asks for a mere donation. The girl in modern school clothing gives her a thoughtless and ignorant “fuck you.”
I don’t know where this picture was taken, but it depicts what our future has become: children disrespecting elders like they were vermin killed flat on the road. I’ve seen this here in California. Little kids on their cell phones undermining what their parents have to say, little kids cussing like there’s no tomorrow, little kids worrying about their looks rather than their family. It’s everywhere; culture and respect are both dying. It’s because of the influences that these kids can easily access: media, drugs, adultery. Our world is losing grasp of the future, and we can only watch as the next generation become total monsters.

Super proud of our Chennai Metropolitan Police for the way they handled a situation involving a friend who went through a painful experience inside a store (Puma) in Express Avenue today - a store employee was found peeking into the trial room through the roof which was accessible from the store room. When my friend realized that despite her having raised an alarm, the store and the mall management was being apathetic toward this bizarre incident, she dialed the women's helpline number (1091) and at least half a dozen police personnel arrived within minutes of the complaint.
Within the next half hour the culprit was caught, taken into custody and the mall management was directed to inspect and secure every trial room in the mall. Not a Rupee was paid to the cops and they even asked my friend if she wanted to be escorted for the rest of her trip to the mall! Ladies, please keep the helpline number (1091) saved on your phone and don't forget to salute an honest officer when you see one I hope the trial rooms in EA are made safe for everyone's sake.

There is one problem with this
Morons, who in other countries / few other states in India, would not be educated, complete college and even manage to get a job in TN
and these morons cannot understand this achievement

In other words those who can't even understand this achievement are graduates here because education is so freely available

The professional skills of the mass churned out by private professional colleges speak for themselves... Struggling young doctors and unemployable engineers.

When I recruit, I often find that dropouts are more employable ( don't read cheap labour), than degree or diploma holders.

The system requires a major overhaul.

The first step in that direction would be to say goodbye to Lord Macaulay.

There are two issues here
1. Denominator bias
2. Education not directly related to needs

Denominator bias
Every year 11 lakh kids are born in TN of which more than 8 lakh complete 12 and around 5 lakh become graduates

Now
Employability when measured as the number of people who are employable divided by number of people needed gives low value in TN because of two reasons

1a.
We make 50 percent of children graduates.
So
Many dull heads also become graduates
ie
Of this 500000, only 300000 would be worth

But

If you had less seats and made only 100000 as graduates, 90000 will be worth

So
When you see actual numbers
You have 300000 who are employable instaed of 90000,
But
Of every 10 applications you get , 4 are waste instaed of 1 waste for every 10

This is an inherent problem in the system
This happens when you produce more graduates and this is just because of numbers

We cannot correct this

We have lot of job options
Unemployment is less
So

Employable people get a good job near their home and don't come to you

In nutshell

Employability decreases as education increases
Employability decreases as unemployment decreases

Both these are positive signs and actually reveal that the society has progressed

This is somewhat like saying that there are lots of seatbelt injuries admitted
That implies more people have worn seat belt and are living . . . that is actually a good sign and not to be worried

So
Reasons for More Seat Belt Injuries are
(1) More People Driving Car (Good)
(2) More Accidents (Bad)
(3) More People Wearing Seat Belt (Good)

In Other words,
when more people driver cars, seat belt injuries will increase and this is inevitable and this is not a sign of concern. In fact it is a sign of progress
When more people wear seat belts, seat belt injuries will increase and this is inevitable and this is not a sign of concern. In fact it is a sign of jubiliation

(To reduce seat belt injuries, we have to look at reducing accidents and not avoiding wearing seatbelt)

Same Way

When you are able to impart education to more people
The "employability" will reduce
and this is not a sign of concern
It is a sign of celebration
This is opposite of unemployment

And
When you have more business opportunities in your place, the person who is more talented will be hired by some one else. So the one who comes to work to you may not be the best
and this is not a sign of concern
It is a sign of achievement
This is opposite of unemployment

Low "employability" due to More Companies and Job Opportunities
are actually causes of celebration and jubilation

The second reason

Education not in sync with requirement alone is the reason for concern

We need a change in syllabus and training
Take MBBS for example
We still have hemiplegia and mitral stenosis in exam

The student will know reverse moustache sign and winter bronchitis and ten syndromes with crossed hemiplegia
But
Do not know how to treat typhoid and malaria

Around 3000 doctors graduate from medical colleges
2900 of them do not know
What is IMA, What is MCI
What is role of DME, What is role of University

How many B Com graduates are taught Tally or Profit ??

Except education of staff nurses and lab technician
Most other courses in India are total to partial waste

These causes are all common to whole of India

It is MCI which frames syllabus for all over India

AICTE for Engineering Colleges

So

Less Employability in TN is not predominantly not due to syllabus or quality of education etc. TN is comparable, if not better than rest of India as far as Quality is concerned

Inspite of More Quality in Education, there is
Less Employability in TN because of More Colleges and More Companies

Even though residents of a city drive safely and there are less accidents, there are more seat belt injuries in that city because many of them wear seat belts

Even though there are more accidents in another city, the seat belt injuries are less because they don't wear seat best

Inspite of More Quantity as well as Quality in Education in TN , there is

Badri Seshadri I made a presentation a month back in an ICTACT event attended by heads of various Engineering Colleges on TN's GER, what we should aim for (60%), what we need to do to go there etc. I am writing that up as an article in Tamil and will post it soon.

TN, no doubt, is the best in India. We should stop comparing ourselves with other states and start working on what we should do to reach the level of European powerhouses. We should of course start working on improving the quality as well, that is a different story.

By the way, 85% of the higher education institutions in TN are private. 83% of the students are enrolled in private. Just FYI for my statist friends here.

Badri Seshadri : Kerala is bad:) Go to the URL I have given and it will give you where every state is. Of the large states, TN, Andhra, Telangana are at the top. I have the figures and graphs in my laptop and will post the graph later. Smaller territories such as Chandigarh, Delhi, Puducherry are above TN.

Badri Seshadri : They ignore the home state of students for GER calculation.

Badri Seshadri : Also note that GER calculation covers even ITI, Polytechnics, Teacher training institutes and all kinds of certification programs above High School.

TN state board and most of the state boards still follow MOTS ( More of the Same) system which is based on rote memorisation. This shows up in their poor performance in IIT exams, even if they join some coaching.

Badri Seshadri Both quantity and quality are important. Whenever one talks of quantity, we see arguments for quality. I prefer unemployable graduates to unemployable high schoolers. I can train the former better. Of course the goal is to improve the standards, for which we got to have the functioning colleges in place.
